Tory Party treasurer Sir Mick Davis blamed fatal protests at one of his company’s mines on ‘neo Marxist anti-capitalist agitators’, according to High Court documents.The mining tycoon, the former chief executive of Xstrata, allegedly made the comments in an email to fellow directors as violent demonstrations at one of the firm’s sites in Peru in 2012 rocked the country.Two men were shot dead in clashes with police at the Tintaya copper mine and villagers are now suing Xstrata for damages in the High Court in London.The locals claim the company, which has since been bought by rival Glencore, should be held liable for the alleged human rights abuses by the Peruvian National Police (PNP). Weeks before the shootings a senior Xstrata executive had described the protesters as ‘sons of whores’, the court papers show.A hearing over whether the case can proceed is due to take place in the High Court in London on October 30, with Glencore insisting the claim is without merit and will fail if it gets to full trial.The local community had been concerned about the mine’s impact, and in 2010-11 an environmental study allegedly found contamination around the mines, according to court papers. Protests began in 2012, with Xstrata’s Peruvian subsidiary, Xstrata Tintaya, allegedly calling in the PNP to police the demonstrations.It is claimed that during several days of protest in May that year, demonstrators were beaten, injured and racially abused by the police. On May 28, Reducindo Puma and Walter Ancca were shot dead.On May 31, Davis, who was appointed Tory treasurer in 2016 having left Xstrata after the Glencore deal, allegedly emailed fellow directors to say the protests were ‘fermented (sic) by the mayor of Espinar (who attended our AGM) and a nexus of neo Marxist anti-mining/capitalist agitators’.The villagers, represented by law firm Leigh Day, claim Xstrata and its Peruvian subsidiary should be liable for the police’s behaviour, saying the firm helped PNP with vehicles and equipment and failed to prevent the use of excessive force.A spokesman for Glencore said: ‘The claimants do not allege that anyone from Xstrata or their private security force at the mine harmed anyone. All the allegations of harm are against the PNP. Xstrata was not responsible for the acts of the PNP in policing the protest and appealed to the PNP to respect the human right of protesters.’Davis declined to comment. 'Putting Ourselves in Their Shoes' tells of the rising resentments among community members to the operations of Tintaya mine through the course of its government ownership and subsequent privatization, and the way these came to a head when ownership passed to BHP Billiton. It relates the process by which non-governmental organisations such as Oxfam Australia, Oxfam America, CooperAccion and Corecami entered the picture, and the important roles they played in helping give birth to the process and/or supporting the communities' ability to engage effectively. It relays the concerns of communities and their leaders, the pressures on the company at the time, and how ultimately, all parties agreed upon the creation of a "Dialogue Table" that identified key issues, principles and ground rules for an ongoing dialogue process that continues to this day. It conveys setbacks for both communities and company in the process, and the ultimate achievement of meaningful and sustainable outcomes. This is one of four films in a series on company-community dialogue produced by the Corporate Social Responsibility Initiative at Harvard Kennedy School on behalf of the mandate of the former Special Representative of the UN Secretary-General for Business and Human Rights, Professor John Ruggie. The films were produced with the generous support of the Government of Norway, the Compliance Advisor/Ombudsman of the World Bank Group, the International Bar Association and the Government of Germany. The films are MATCH productions. On November 29, 2012, the series won "best communication or publication" award at the biennial Centre for Effective Dispute Resolutions (CEDR) awards ceremony held in London. The company was founded in 1926 in Switzerland as Südelektra, an infrastructure and electricity projects concern operating in Latin America. In 1990, Marc Rich + Co AG became its majority shareholder. In the 1990s it diversified into mining and disposed of its non-core businesses. It was first listed on the London Stock Exchange in 2002 at which time it acquired Glencore's coal assets in Australia and South Africa. In 2003, it doubled in size with the A$2.9 billion takeover of Australian copper, zinc and lead miner MIM Holdings. However, it failed in a 2005 bid for another Australian miner, WMC Resources, which was captured by BHP Billiton, the world's biggest mining company. In 2004 Xstrata closed its recently purchased Windimurra Vanadium plant in Western Australia which had the effect of increasing Vanadium prices received for Xstrata's other Vanadium mines around the world. Many hundreds of people were put out of work and now many Western Australians are not keen to see Xstrata involved in other mining activities in the state because of this action. In August 2005, Xstrata purchased a 19.9% stake in Falconbridge Limited, a diversified Canadian mining company producing copper, nickel, aluminum, lead and zinc. Following a contested take-over battle with Inco Limited, Xstrata successfully acquired the remaining 80.1% of Falconbridge in August 2006. In 2006, The Northern Territory and Australian Governments approved the expansion of the McArthur River zinc mine, near the popular fishing destination of Borrooloola. The expansion involves diversion of the river to a new 5.5 km channel, to allow construction of a massive open-cut pit in the existing river. On behalf of the Traditional Owners of the region -- the Yanyuwa, Mara, Garrawa and Gurdanji peoples -- the Northern Land Council launched a legal challenge to the Northern Territory Government's decision to approve the mining of and diversion of the McArthur River. On 1 May 2007, The Northern Territory Supreme Court ruled in favour of the Northern Land Council to stop the expansion. On 3 May 2007, the Northern Territory government rushed through retrospective legislation to overrule the court decision and allow the open-cut mine to proceed. On 28 May 2012 violent repression of local residents by the police in the province of Espinar, Cuzco, Peru, caused the deaths of two civilians. The inhabitants protested against the pollution of the water sources caused by Xstrata's mining activities. The government has decreed a State of Emergency and suspended civil liberties guaranteed in the Constitution. Since the turn of the millennium it has developed from a small player into one of the world's largest diversified mining groups with the help of a series of large acquisitions. In 2008, its degree of transnationality according to the Transnationality Index was 93.2 percent and ranked first place.It has major operations/projects in eighteen countries (Australia, Argentina, Brazil, Canada, Chile, Colombia, the Dominican Republic, Germany, Jamaica, New Caledonia, Norway, Papua New Guinea, Peru, South Africa, Spain, Tanzania, the United States and the United Kingdom) and it is a major producer of copper, coking coal, thermal coal, nickel, ferrochrome, vanadium and zinc. It has smaller scale involvement in aluminum, gold, lead and silver. It also has interests in platinum group metals through its 24.9% stake in Lonmin. In July 2012, Xstrata opened its first office in mainland China. China accounts for up to one-third of Xstrata's global sales. The office is located in Shanghai. Bulga Coal Xstrata are currently the operators of the Bulga Coal Mine in NSW, Australia. Xstrata have managed this mine on behalf of the Bulga Coal Pty Ltd shareholders since 2001 when it purchased Enex Resources Limited from Glencore International AG. The Bulga Coal mine site serves as the headquarters for Xstrata Coal's NSW division. In 2007 Xstrata Coal, based in Sydney, bought Anvil Hill Coal Mine from Centennial Coal Company. Since the purchase of the Anvil Hill Coal Mine Xstrata Coal, an Australia-based subsidiary of Xstrata PLC, has come under media scrutiny numerous times in regards to the company's management of the pre-mining stage of the mining project, most notably scrutinised has been the community relations approach of Xstrata Coal towards the local community, with allegations of misleading actions on behalf of the company being cited in the local and regional media, and other regional and local communication channels. This included the setting up of a local action group in opposition to the mine named WAG (Wybong Action Group). Xstrata's A$274 million expansion plan for the George Fisher mine at Mount Isa was approved by the government of Queensland Mindanao, Philippines Xstrata's $5.9-million copper-gold mine in the Philippines' southern island of Mindanao has been delayed three years to 2019 due to security concerns and regulatory obstacles set by the local government.

Glencore confirms sale of mines in Australia and Chile
Embattled mining giant Glencore said it has started the sales process for two of its copper mines in Australia and Chile. The firm's Australian copper mine in Cobar, New South Wales, and its Lomas Bayas copper mine in the Atacama desert in Chile are for sale. Glencore is attempting to reduce $30bn (£19.5bn) of debt created by its 2013 takeover of Xstrata. Its Hong Kong-listed shares have also fallen some 55% this year. Trading of the firm's Hong Kong-listed shares were halted earlier on Monday ahead of the announcement. "The sale process is in response to Glencore receiving a number of unsolicited expressions of interest for these mines from various potential buyers," the firm said in an email. "This will allow potential buyers to bid to purchase either one or both of the mines and may or may not result in a sale," it added. The Cobar operation is a high-grade underground mine and plant, while the Lomas Bayas operation is a low-cost, open pit mine. In Australia, Glencore has 19 mining complexes across the country, including coal, copper, nickel and zinc operations, port facilities, offices and agricultural businesses, among others. It is one of the biggest exporters of Australian grain. In Chile, Glencore owns and has stakes in several mines, as well as a hydro-power project. Last week, the firm announced it would dramatically cut its zinc production. The move comes amid a 30% fall in the price of zinc in recent months. The company said it would cut 500,000 tonnes of zinc production - or 4% of the world's total supply. Most of the zinc-related cutbacks will be in Australia, where more than 500 jobs will be lost, as well as South America and Kazakhstan. As it attempts to reduce its debt, the firm has also cut copper production and suspended dividend payments to shareholders. It is also issuing new shares to raise money.

Cabe precisar, que en un primer momento la empresa minera les reponía cuando una oveja se moría con otra de la misma especie, pero ahora que la muerte de esta animal es cada vez más frecuente, decidieron ya no dar ovejas, sino vacunos.
